Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between Australia Mining Visa ("the Company", "we", "us", "our") and any individual ("Client", "you", "your") who engages our immigration and mining placement services. These Terms govern all aspects of that relationship — from initial enquiry through to post-placement support.
Definitions
Company: Australia Mining Visa, operating at australiaminingvisa.com
Client: Any individual who submits an enquiry, signs a service agreement, or makes payment for our services
Services: Immigration consulting, visa application management, White Card facilitation, mining sector placement, and arrival support
Service Agreement: The written agreement signed between the Client and the Company before paid services commence
Visa Application: An application lodged with DOHA for a work visa under subclass 417, 462, or 482
White Card: The general construction induction certificate required to legally work on Australian mining sites
Placement Employer: Any of the Company's 17 partner mining companies with whom the Client is placed following visa grant
Service Fee: The total cost of $3,100 USD for the full service package
DOHA: The Australian Department of Home Affairs
Acceptance of Terms
You accept these Terms and enter into a binding agreement with the Company when you:
- Submit a contact or application enquiry via our website, email, or WhatsApp
- Sign the Service Agreement provided by the Company
- Make the first payment instalment of $1,550 USD
- Provide personal documents to the Company for the purpose of a visa application
You must be at least 18 years of age to engage our services. By accepting these Terms, you confirm that you meet this requirement.
Our Services
The standard service package includes:
Eligibility Assessment: Review of your profile and documents to determine visa eligibility and suitable placement options
Document Collection: Guided collection and verification of required documents (passport copy, birth certificate, proof of address)
White Card Facilitation: Support through the online general construction induction training (4–7 hours), cost included in the Service Fee
Work Agreement: A 12-month work placement with a partner mining company, renewable twice for up to 3 consecutive years total
Visa Application: Preparation and lodgement of your Australian work visa (subclass 417, 462, or 482) through the appropriate Embassy or DOHA portal
Arrival Support: Assistance on your day of arrival including the medical examination and formal introduction to your Placement Employer
Services not explicitly listed above are not included. Any additional services will require a separate written agreement and additional fees.
Client Eligibility
To be eligible for our services, Clients must:
- Be at least 18 years of age at the time of application
- Hold a valid passport from an eligible country for the relevant visa subclass
- Have no visa refusals or cancellations that would disqualify future Australian visa applications
- Be in good health or disclose any known medical conditions affecting visa eligibility
- Have no criminal convictions constituting a character concern under Australian immigration law
- Genuinely intend to work in Australia's mining sector upon visa grant
The Company reserves the right to decline services to any individual who does not meet eligibility requirements or where providing services would breach Australian law. Fees paid before an eligibility assessment will be refunded in full in such cases.
It is the Client's responsibility to disclose all personal circumstances honestly and completely. Providing false or misleading information may result in visa refusal and forfeiture of paid fees.
Fees & Payment
Service Fee
The total Service Fee is $3,100 USD, payable in two equal instalments:
First Payment — $1,550 USD: Due upon signing the Service Agreement
Second Payment — $1,550 USD: Due upon official visa grant by DOHA
What the Fee Includes
- White Card online training fee
- Visa application preparation and lodgement
- Mining company placement and work agreement
- Arrival support and employer introduction
- Medical examination support on arrival
The following are not included in the Service Fee: Australian Government visa application charges, airfare to Australia, and medical examination fees payable to the provider.
Accepted Payment Methods
Bank Transfer (Wire Transfer): To the Company's nominated account. Bank details are provided in the Service Agreement. The Client is responsible for any transfer fees charged by their bank.
USDT (Tether): Via TRC-20 or ERC-20 network. Wallet address provided upon request. The Client is responsible for any network gas fees.
All payments must be made directly to Australia Mining Visa. Services do not commence until the first instalment is confirmed as received. Written confirmation of receipt will be issued within 2 business days.
Refund Policy
We implement reasonable security measures to protect your personal information, including:
Before Service Agreement is signed: No fee has been charged. No refund applicable.
After first instalment — before visa lodgement: A partial refund of up to 50% of the first instalment ($775 USD) may be issued at the Company's discretion, less any costs already incurred.
After visa application is lodged: No refund of the first instalment is available, as work has been substantially completed.
Visa refusal by DOHA (not the Client's fault): The Company will re-assess and re-lodge where possible at no additional charge. No refund of the first instalment will be issued.
Visa refusal due to Client error or non-disclosure: No refund will be issued.
Second instalment: Non-refundable once paid, as visa approval has been achieved and services fully rendered.
Refund requests must be submitted in writing to australiaminingvisa@gmail.com within 14 days of the triggering event.
Client Obligations
The Client agrees to:
Truthful Disclosure: Provide complete and accurate information at all times, including personal details, health status, and criminal record
Document Submission: Supply all required documents promptly and in a legible format
White Card Completion: Complete the online White Card training within the timeframe specified by the Company
Timely Communication: Respond to requests for information within 5 business days
Genuine Intent: Genuinely intend to take up the offered employment in Australia upon visa grant
Compliance with Australian Law: Abide by all Australian laws and visa conditions upon arrival
Fee Payment: Make all payments by the due dates in the Service Agreement
DOHA Contact: Not independently contact DOHA about an application managed by the Company without first notifying us
Cookies & Tracking
The Company makes no guarantee of visa approval. All visa decisions are made exclusively by the Australian Department of Home Affairs (DOHA) and are outside the control of Australia Mining Visa.
The Company will select the most appropriate visa subclass based on the Client's profile. Processing times are determined by DOHA and may vary. Changes to the Client's personal circumstances after lodgement must be reported to the Company immediately. In the event of an initial refusal, the Company will advise on potential grounds for re-lodgement.
Employment Terms
Duration: The initial work agreement is for 12 months, renewable twice for up to 3 consecutive years total
Role Allocation: The specific role is determined by the Placement Employer based on the Client's profile and available positions
Salary: Set by the Placement Employer under Australian employment law. Typical general mining roles range from AUD $145,000–$155,000 per year — indicative only, not guaranteed
Work Schedule: FIFO/DIDO and residential schedules are determined by the Placement Employer. Common arrangements include "8 days on, 6 days off" and "2 weeks on, 1 week off"
Camp Facilities: Where FIFO/DIDO applies, accommodation, meals, and transport are typically provided by the Placement Employer
Employment Relationship: The employment contract is directly between the Client and the Placement Employer. Australia Mining Visa is not the Client's employer
Termination by Employer: The Placement Employer may terminate the work agreement under Australian employment law. The Company is not liable for early termination by the employer
All employment conditions are governed by the Fair Work Act 2009 (Cth) and the applicable Modern Award.
Confidentiality
The Company will not disclose your personal information to any third party except as required to deliver the agreed services or as required by law. Client documents are stored securely and accessed only by authorised personnel.
The Client agrees not to disclose any proprietary information shared by the Company, including partner mining company details, internal processes, or strategic information. Confidentiality obligations survive termination of the Service Agreement for a period of 3 years.
Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for: visa refusals by DOHA; changes to Australian immigration policy or law; delays caused by government processing times; actions or omissions of the Placement Employer; loss of income during the visa processing period; the Client's conduct or breach of visa conditions in Australia; or the consequences of the Client's false or misleading disclosures.
The Company's total liability to the Client under any circumstances shall not exceed the total Service Fee paid by the Client ($3,100 USD). Nothing in these Terms limits liability for death or personal injury caused by gross negligence or fraud.
Termination
By the Client
The Client may terminate the Service Agreement at any time by providing written notice. Termination is subject to the refund policy in Section 6. Any work already completed will not be refunded.
By the Company
The Company may immediately terminate the agreement if the Client provides false information, fails to make payment within 7 days of written notice, engages in abusive conduct toward staff, or if continuing services would require the Company to breach Australian law.
Upon termination, the Company will return the Client's original documents within 14 days and cease all work on the case. Confidentiality obligations survive termination.
Intellectual Property
All content on the Australia Mining Visa website — including text, design, graphics, documents, and templates — is the intellectual property of Australia Mining Visa and is protected by applicable copyright and trademark laws. Clients may not reproduce or distribute any Company materials without prior written consent.
Client-owned documents submitted to the Company remain the property of the Client at all times.
Disputes
In the event of a dispute, both parties agree to attempt resolution in good faith through the following process:
Step 1 — Direct Negotiation: Contact us in writing at australiaminingvisa@gmail.com. We will respond with a proposed resolution within 10 business days.
Step 2 — Mediation: If direct negotiation fails within 30 days, either party may refer the matter to a mutually agreed independent mediator. Costs are shared equally.
Step 3 — Legal Action: If mediation does not resolve the matter, either party may pursue legal remedies in the courts of Western Australia.
Governing Law
These Terms are governed by the laws of Western Australia, Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia for any disputes not resolved through the process in Section 14.
Applicable legislation includes the Migration Act 1958 (Cth), the Privacy Act 1988 (Cth), the Fair Work Act 2009 (Cth), and the Australian Consumer Law. Nothing in these Terms excludes rights granted to consumers under applicable law.
Amendments
The Company reserves the right to amend these Terms at any time. Updated Terms will be published at australiaminingvisa.com/terms-and-conditions with a revised effective date. Clients with active Service Agreements will be notified at least 14 days before changes take effect. Continued engagement with our services after the effective date constitutes acceptance of the revised Terms.
